These Terms of Use (“Terms”) govern your access to and use of the Olympia Outdoor Living website and related online services.
By accessing or using this website, you agree to these Terms. If you do not agree, please do not use the website.
1. Purpose of the Website
The Olympia website provides information regarding outdoor-living products, sourcing, custom site furnishings, project-related services, Plan Review, and other Olympia capabilities.
Unless expressly stated otherwise, website content is provided for informational and business-development purposes.
Website content does not by itself constitute:
- A binding proposal or quotation
- Acceptance of an order
- A contract
- Professional architectural or engineering advice
- Code or regulatory approval
- A product-availability guarantee
- A commitment regarding pricing or lead time
Any actual purchase, project, quotation, or service arrangement may be governed by separate written terms.
2. Product and Sourcing Information
Olympia works with manufacturers, suppliers, fabricators, distributors, and other sourcing resources.
Brands displayed on our website are selected examples of Olympia's sourcing experience and do not necessarily represent our complete sourcing network.
References to a particular manufacturer, brand, product, or product category do not guarantee:

- Manufacturer availability
- Pricing
- Lead time
- Geographic availability
- Suitability for a particular project
- Custom fabrication feasibility
- Compliance with plans, specifications, codes, or project requirements
These matters are evaluated on a project-by-project basis.
Unless expressly stated and separately substantiated, references to brands do not represent exclusivity, ownership, endorsement, manufacturer affiliation, or any particular dealer or distribution status.
3. Custom Site Furnishings
Olympia may assist customers with sourcing and coordination involving custom pergolas, planters, benches, furnishings, structures, site amenities, and other specialty products.
Custom requests may require evaluation of:

- Supplier capabilities

Unless expressly agreed in writing, Olympia does not represent that it is the manufacturer, architect, engineer, code-certification authority, or installer of a custom product.
Availability and feasibility are confirmed on a project-by-project basis.
4. Contact, Project, and Quote Inquiries
The website may allow you to submit general inquiries, sourcing requests, project information, or requests for quotation.
Submitting an inquiry does not:
- Create a contract
- Constitute Olympia's acceptance of an order
- Guarantee that Olympia can provide a requested product or service
- Guarantee product availability
- Guarantee pricing
- Reserve inventory
- Reserve production capacity
- Establish a guaranteed response, shipping, or delivery time
Any quotation, proposal, purchase, or service arrangement may be subject to separate written specifications, pricing, approvals, payment terms, and acceptance.
A binding transaction arises only through the applicable agreement or acceptance process.
5. Supplier and Manufacturer Coordination
By submitting a project, sourcing, or quote inquiry, you authorize Olympia to use the information you provide to evaluate and respond to your request.
Where reasonably necessary, relevant project information may be shared with manufacturers, suppliers, fabricators, distributors, or other resources for purposes such as evaluating:
- Availability
- Pricing
- Lead time
- Fabrication feasibility
- Product selection
- Alternatives
- Materials or finishes
- Other project requirements
You are responsible for ensuring that you have the right to provide Olympia with the information you submit.
6. Plan Review
Olympia may describe or provide a Plan Review capability intended to help identify outdoor-living scope from project drawings, specifications, and related documents.
Unless the website expressly identifies Plan Review intake as operational, descriptions of that process are informational and describe planned functionality.
Descriptions of planned features do not constitute a representation that those features are presently available.
If Plan Review or other project-analysis functionality becomes operational, outputs may require human review and should not be treated as a substitute for professional architectural, engineering, legal, code, safety, or other licensed professional advice.
7. Information and Materials You Submit
You are responsible for the accuracy and completeness of information and materials you provide to Olympia.
By submitting information or materials, you represent and warrant that you have the right and authority to provide them to Olympia for the applicable business purpose and to permit Olympia to use them as described in these Terms.
Submitted materials may include, where an applicable Olympia service permits them:
- Project information
- Specifications
- Architectural or construction drawings
- Plans
- CAD files
- Product schedules
- Photographs
- Renderings
- Technical documents
- Other project-related materials
You represent and warrant that materials you submit do not infringe, misappropriate, or otherwise violate any copyright, trademark, trade secret, contractual right, privacy right, or other intellectual-property or proprietary right of any third party.
You grant Olympia permission to use submitted information and materials as reasonably necessary to:
- Review your inquiry
- Communicate with you
- Evaluate products or sourcing options
- Investigate fabrication options
- Prepare quotations or proposals
- Coordinate with relevant manufacturers, suppliers, fabricators, distributors, or service providers
- Provide requested services
To the extent permitted by applicable law, you agree to indemnify and hold Olympia harmless from third-party claims arising from materials you submitted without sufficient ownership, license, permission, or authority. This obligation is subject to the limitations and other provisions of these Terms.
Do not submit passwords, payment-card information, government identification numbers, highly sensitive personal information, trade secrets, or information that you are not authorized to disclose through our general contact form.
Olympia's current general contact form does not provide project-document upload functionality. These provisions also apply to document or project-upload functionality if such functionality is introduced in the future.
8. Acceptable Use
You may not use the website to:
- Violate applicable law
- Submit fraudulent, unlawful, false, or materially misleading information
- Attempt unauthorized access to the website or related systems
- Circumvent website security or access controls
- Introduce malware or malicious code
- Interfere with the operation or availability of the website
- Use automated systems in a manner that materially burdens or disrupts the website
- Infringe Olympia's or another person's intellectual-property or other legal rights
Olympia may restrict or block access where reasonably necessary to protect its systems, customers, service providers, or legal rights.

Manufacturer names, logos, trademarks, service marks, and other brand identifiers displayed on the website remain the property of their respective owners.
Their appearance on the Olympia website does not transfer ownership of those marks to Olympia.
The display of a third-party brand is intended to identify relevant manufacturers, products, sourcing experience, or project information and does not, standing alone, establish exclusivity or any particular legal relationship.

The website may contain links to manufacturers, featured brands, suppliers, or other third-party websites.
Third-party websites are operated independently and are not controlled by Olympia.

A link from Olympia does not by itself constitute a guarantee or endorsement of every statement, product, service, policy, or practice appearing on the linked website.

You may not attempt to defeat, bypass, interfere with, or misuse these protections.
13. Website Availability and Changes
Olympia may modify, suspend, remove, or discontinue website content, features, products, services, or functionality.
We do not guarantee that the website will always be available, uninterrupted, secure, or error-free.
Website information may become outdated. Olympia does not undertake an obligation to update every item immediately unless required by applicable law or a separate agreement.

For claims arising solely from your access to or use of the public website, Olympia's total aggregate liability to you will not exceed the greater of:
- $100.00; or
- The amount, if any, you actually paid to Olympia specifically for access to the website during the twelve months immediately preceding the event giving rise to the claim.
This website-use liability cap does not replace or modify liability provisions contained in a separate written agreement governing an actual product purchase, quotation, project, or contracted service. Any such transaction may be governed by the terms of the applicable agreement.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.
16. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold Olympia harmless from claims, liabilities, losses, damages, and reasonable costs arising from:
- Your unlawful misuse of the website
- Your violation of these Terms
- Information or materials you submit without appropriate authority
- Your infringement of another person's rights
This provision does not apply where prohibited by applicable law.

Cookie and tracking preferences may be managed through the consent controls provided on the website, including the control where available.
The website implementation provides access to the current Privacy Policy and applicable cookie-consent controls.
18. Governing Law; Jurisdiction and Venue
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law principles, except where applicable law requires otherwise.
To the extent a dispute arising solely from these Terms or use of the website is properly brought in state court, you and Olympia consent to the exclusive jurisdiction and venue of the applicable state courts located in Union County, North Carolina.
To the extent such a dispute is properly subject to federal jurisdiction, you and Olympia consent to jurisdiction and venue in the United States District Court for the Western District of North Carolina.
You waive any objection to such jurisdiction or venue to the extent that waiver is permitted by applicable law.
This provision does not override a valid dispute-resolution, arbitration, jurisdiction, or venue provision contained in a separate written agreement governing an actual product purchase, quotation, project, or contracted service.
Nothing in this section prevents either party from seeking relief in another forum where applicable law does not permit the jurisdiction or venue provisions above to be enforced.
19. Changes to These Terms
Olympia may update these Terms from time to time.
When changes are made, we will update the Effective Date at the beginning of these Terms.
Your continued use of the website after revised Terms become effective constitutes acceptance to the extent permitted by applicable law.
